Simple laborers must receive 100% of the minimum wage during the probationary period. And if the work contract is less than a year, even non-simple laborers must receive 100% of the minimum wage. Note that no severance pay applies to work contracts of less than one year.
The conditions for receiving 90% of the minimum wage are as follows:
- If the work contract is for more than a year
- If the work contract is indefinite
- If the labor contract was made to receive 90% of the minimum wage during the 3-month probationary period
- If the job is not a simple labor job as explained above
- Therefore, simple laborers must receive 100% of the minimum wage, not 90%, even during the probationary period.
